1. Acceptance of these terms

By creating an account, accessing or using QTSurfer, you agree to these terms and to the Privacy notice. If you do not agree, do not use the service.

2. The service

QTSurfer provides tools to create, test, analyse and manage quantitative trading strategies. Features, availability conditions and any subscription plans will be described in the service and, where applicable, in a separate order or subscription agreement.

3. Eligibility and accounts

You must provide accurate account information, keep your credentials confidential and notify us promptly of any unauthorised use. You are responsible for activity carried out through your account, unless applicable law says otherwise.

4. No financial advice or guarantee

QTSurfer is a software platform, not a broker, financial adviser, investment manager or custodian. Content, strategies, backtest results, market data and other outputs are provided for information and technical use only. They are not a recommendation, offer or invitation to buy, sell or hold any asset.

Past performance, simulated performance and backtest results do not predict future results. Trading and investing involve a risk of loss, including the possible loss of all capital. You are solely responsible for your decisions, orders, exchange connections and compliance with the laws that apply to you.

5. Acceptable use

You must not misuse the service, interfere with its operation, bypass security measures, access it in an unauthorised manner, infringe another person’s rights, or use it in breach of applicable law. You must not submit malicious code, use the service to manipulate markets, or use automated means beyond the interfaces we expressly provide.

6. Your content and strategies

You retain ownership of the strategies, data and other content you submit, subject to the rights needed to operate, secure and improve the service. You confirm that you have the necessary rights to submit that content. Terms for sharing, licensing or selling strategies through a marketplace, if offered, will be stated separately.

7. Intellectual property

QTSurfer and its licensors retain all rights in the service, software, branding and documentation, except for your content and rights expressly granted to you. We grant you a limited, revocable, non-transferable right to use the service in accordance with these terms.

8. Availability and changes

We may maintain, update, suspend or discontinue features to protect the service, comply with law or improve it. We will use reasonable efforts to give notice where a material change is expected to affect your use, subject to security, legal and operational constraints.

9. Disclaimers and limitation of liability

This section must be reviewed for the governing law and the final commercial model. To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of uninterrupted availability, accuracy, fitness for a particular purpose or freedom from errors. Liability limitations, exclusions, indemnities and any liability cap must be added here after legal review.

10. Suspension and termination

We may suspend or terminate access where reasonably necessary to address a breach of these terms, security risk, fraud, legal requirement or harm to other users or the service. You may stop using the service at any time, subject to any applicable subscription terms.

11. Changes to these terms

We may update these terms. For material changes, we will provide reasonable notice through the service or by another appropriate method. Continued use after the effective date of updated terms means that you accept them, where permitted by law.
